Terms of Service

Please read these terms carefully before using the Zitran Mobility website, joining any waitlist, or using any Zitran service.

1. Definitions

  • "Zitran", "we", "us", "our" refers to Zitran Mobility Limited, a company registered in the Republic of Ghana and a subsidiary of ZinFIn Group Limited.
  • "Platform" means the Zitran website at zitran.net, any associated mobile application, and any booking or dispatch system operated by Zitran.
  • "Rider" / "Passenger" means any person who books or travels on a Zitran-operated vehicle.
  • "Captain" means any driver vetted, trained, and engaged by Zitran to operate vehicles on the Zitran network.
  • "Fleet Partner" means a vehicle owner who has entered into a fleet partnership agreement with Zitran.
  • "Service Partner" means a third-party business (healthcare, catering, or other) that partners with Zitran to deliver services to riders.
  • "Zitran Access" means Zitran's pre-booked, wheelchair-accessible paratransit service for persons with disabilities and mobility challenges.
  • "Access Captain" means a Captain specifically trained to assist riders with mobility challenges on Zitran Access vehicles.

2. Service Description

Zitran operates a technology-powered, subscription-based bus transit network within Greater Accra, Ghana. Our services include:

  • Scheduled fixed-route transit — air-conditioned, subscription-based bus services on defined routes.
  • Corporate shuttle partnerships — dedicated routes and plans for businesses.
  • Zitran Access — pre-booked, wheelchair-accessible paratransit (see Section 5 below).
  • Fleet partnerships — vehicle owners partnering with Zitran for fleet operations.
  • Service partnerships — healthcare, catering, and other service providers connecting to the Zitran network.

Where features are labelled "coming soon" or presented as part of a waitlist, no active service is being offered. Such content constitutes expressions of intent only and does not create a binding obligation.

3. Pre-Launch & Waitlist

Joining any waitlist — whether as a rider, Captain, Fleet Partner, or Service Partner — does not constitute a binding agreement, reservation, or guarantee of any kind. Routes, pricing, schedules, and partner terms are subject to change at our sole discretion prior to and after launch. Driver and Fleet Partner applications do not constitute employment offers or partnership contracts until a separate written agreement is executed.

4. Eligibility & User Responsibilities

By using the Platform you represent that you are at least 18 years of age (or using the Platform with the consent of a parent or legal guardian) and that the information you provide is accurate and complete. You agree to:

  • Provide truthful, current contact and registration information.
  • Comply with all applicable laws of the Republic of Ghana.
  • Not use the Platform for any fraudulent, unlawful, or abusive purpose.
  • Not attempt to reverse-engineer, scrape, or interfere with the Platform.
  • Treat Captains, fellow riders, and Zitran staff with respect and dignity.
  • Follow all safety instructions provided by Captains and vehicle signage.

5. Zitran Access — Accessible Transport

CRITICAL NOTICE

Zitran Access is NOT an emergency service, ambulance service, or medical transport service. Do not use Zitran Access in place of calling an ambulance or emergency services. In any medical emergency, always call the Ghana National Ambulance Service (112 / 193) or your nearest emergency facility immediately.

5.1 Nature of the Service

Zitran Access provides pre-booked, non-emergency, wheelchair-accessible transport for persons with disabilities and mobility challenges. The service is designed for scheduled trips such as medical appointments, rehabilitation sessions, daily commuting, social outings, and other non-emergency travel needs. Zitran Access is a point-to-point transport service only.

5.2 No Medical Personnel or Equipment

Zitran Access vehicles do not carry medical equipment (including but not limited to oxygen, IV drips, monitors, stretchers, or defibrillators). Access Captains are trained in passenger assistance and wheelchair securing — they are not medical professionals, paramedics, nurses, or healthcare workers. Access Captains do not administer medication, provide medical advice, or perform any clinical or therapeutic procedure.

5.3 Fitness to Travel

Riders using Zitran Access must be medically fit to travel without ongoing medical supervision during the journey. If a rider's medical condition requires continuous monitoring, life-support equipment, or the presence of a medical professional during transit, Zitran Access is not a suitable service and should not be used. Zitran reserves the right to refuse service where, in the Captain's reasonable judgement, a rider's condition poses a risk to their own safety or the safety of others.

5.4 Caregiver & Guardian Responsibility

Where a booking is made on behalf of another person by a caregiver, guardian, healthcare facility, or other third party, the person making the booking accepts full responsibility for:

  • Confirming the rider is medically fit to travel without medical supervision.
  • Ensuring the rider is accompanied by a personal aide if their condition requires one — Captains are not personal care assistants.
  • Providing accurate information about the rider's mobility needs, wheelchair type, and any special requirements at the time of booking.
  • Being present (or arranging a responsible adult to be present) at both pick-up and drop-off points to assist with boarding and alighting if needed.

5.5 Pre-Booking Requirement

All Zitran Access rides must be pre-booked a minimum of 24 hours in advance. On-demand or walk-up rides are not available for Zitran Access. Zitran reserves the right to cancel or reschedule bookings where operational constraints prevent safe service delivery.

5.6 Wheelchair & Mobility Device Policy

Zitran Access vehicles are equipped with hydraulic ramps and 4-point wheelchair securing systems. Riders must use a manual or powered wheelchair that is compatible with the vehicle's securing system. Zitran is not liable for damage to mobility devices that are not properly secured, are in a state of disrepair, or exceed the vehicle's weight and dimensional limits. Riders must inform Zitran of the type and dimensions of their mobility device at the time of booking.

5.7 Incident During Transit

If a rider experiences a medical event during a Zitran Access journey, the Captain will stop the vehicle in a safe location and immediately call emergency services (112 / 193). The Captain will not attempt to provide medical treatment. Zitran shall not be liable for delays, detours, or outcomes arising from medical events that occur during transit.

5.8 Healthcare Facility Partnerships

Where healthcare facilities use Zitran Access to transport patients, clients, or residents, the facility assumes responsibility for assessing each individual's fitness to travel and ensuring appropriate accompaniment. The facility must execute a separate Service Partner Agreement before transport is commenced. Zitran does not accept clinical or medical liability for any patient transported under such arrangements.

6. Service Partners

6.1 Healthcare Partners: Healthcare partners who connect to the Zitran network for patient transport services do so subject to a separate Service Partner Agreement. Zitran does not hold itself out as a healthcare provider. All clinical decisions — including fitness to travel — remain the sole responsibility of the referring healthcare facility or practitioner. Zitran accepts no liability for medical outcomes, treatment delays, or clinical decisions associated with transport.

6.2 Catering Partners: Catering partners who supply food and beverages through the Zitran network are solely responsible for food safety, hygiene, allergen labelling, and compliance with Ghana Food and Drugs Authority regulations. Zitran acts as a marketplace connecting riders with catering partners and is not liable for foodborne illness, allergic reactions, or any other harm arising from food or beverages provided by Service Partners.

6.3 General: Service Partners are independent businesses and are not employees, agents, or affiliates of Zitran. Zitran does not endorse, guarantee, or warrant the quality, safety, or suitability of any third-party service offered through the Platform.

7. Booking, Cancellation & Refunds

Specific booking, cancellation, and refund policies will be published at or before commercial launch. In general:

  • Subscription fees are payable in advance and cover a defined number of trips or period.
  • Unused trips within a subscription period do not roll over unless otherwise stated.
  • No-shows and late cancellations may be subject to forfeiture or fees as detailed in the booking flow.
  • Refund requests will be assessed on a case-by-case basis. Where a ride cannot be provided due to Zitran's fault (vehicle breakdown, service cancellation), a credit or refund will be issued.

8. Assumption of Risk & Indemnification

8.1 Assumption of Risk: You acknowledge that the use of any transport service carries inherent risks, including but not limited to traffic accidents, delays, breakdowns, and unforeseen events. By using any Zitran service, you voluntarily assume these risks to the fullest extent permitted by law.

8.2 Indemnification: You agree to indemnify, defend, and hold harmless Zitran Mobility Limited, ZinFIn Group Limited, their officers, directors, employees, Captains, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • Your breach of these Terms.
  • Your misuse of the Platform or any Zitran service.
  • Any injury or damage arising from your failure to disclose relevant medical or mobility information (Zitran Access).
  • Any claim by a third party related to a booking you made on behalf of another person.
  • Your violation of any applicable law or regulation.

9. Intellectual Property

All content on this site — text, graphics, logos, software, the Zitran name and branding — is owned by or licensed to ZinFIn Group Limited and sublicensed to Zitran Mobility Limited. You may not reproduce, distribute, or create derivative works without prior written permission.

10. Limitation of Liability

To the maximum extent permitted by the laws of the Republic of Ghana:

  • Zitran Mobility Limited and ZinFIn Group Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use any Zitran service or the Platform.
  • Zitran's total cumulative liability for any claim shall not exceed the amount paid by you to Zitran in the 3 months preceding the event giving rise to the claim.
  • Zitran shall not be liable for delays, cancellations, or service disruptions caused by traffic, weather, road conditions, vehicle breakdowns, government directives, or other circumstances beyond our reasonable control.
  • Zitran shall not be liable for any injury, loss, or damage arising from a rider's failure to disclose a medical condition, disability, or mobility requirement that is relevant to safe transport.
  • Zitran shall not be liable for the acts, omissions, products, or services of any Service Partner (healthcare or catering) operating on the network.

11. Insurance

All vehicles operating on the Zitran network carry third-party motor insurance as required under the Motor Vehicles (Third Party Insurance) Act 1958 (Act 42) of Ghana. Additional comprehensive insurance may be maintained at Zitran's discretion. Insurance coverage does not extend to personal belongings, medical expenses arising from pre-existing conditions, or losses not directly caused by the operation of the vehicle.

12. Third-Party Services

The Platform integrates with the following third-party providers: Cloudflare (security and bot protection), Supabase (data storage), HubSpot (CRM), and Resend (email delivery). Use of our forms is also subject to those providers' terms and privacy policies. We are not responsible for their acts or omissions.

13. Privacy

Your use of the Platform is governed by our Privacy Policy, incorporated into these Terms by reference. By submitting any form or using any service, you confirm you have read and understood our Privacy Policy.

14. Force Majeure

Zitran shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government action or directive, strikes, fuel shortages, power outages, road closures, civil unrest, or any event of force majeure recognised under Ghanaian law.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Ghana. Any dispute arising out of or in connection with these Terms shall first be submitted to good-faith mediation. If mediation fails within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts of Ghana.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Platform or any Zitran service after an update constitutes acceptance of the revised Terms.
